The Bombay High Court's Nagpur bench has directed the additional commissioner and registrar of cooperative society, Pune, to complete an enquiry into allegations of irregularities by the directors of Nirmal Ujjwal Cooperative Bank by November 30.
The court's direction came after the state government informed the court that an enquiry against the directors under Section 78(1) of Maharashtra Cooperative Societies Act, 1960 is fixed for final hearing on October 26 and it would be finished by November first week.
The judges disposed of the plea filed by Govind Kukse after these directions. Shrikant Khandalkar was the counsel for petitioner while assistant government pleader Anil Sonak held brief for the government.
According to Khandalkar, the petitioner had complained about alleged illegalities committed by the directors of Nirmal Ujjwal Cooperative Bank to the cooperatives commissioner and accordingly an enquiry was initiated against them on January 1 last year under Maharashtra Cooperative Societies Act. In July last year, the directors challenged this action in the high court, on which they were given protection of two weeks.
Nonetheless, the petitioner alleged that the directors were adopting delaying tactics on vague grounds that led to adjournment of hearing on enquiry as many as 20 times. The petitioner had prayed for expeditious end to the enquiry within the stipulated period.
